- Handle yourself in a cooperative manner without anger or defensiveness. A poor attitude towards the officer will increase your chances of being arrested. Always remain calm. Any time you are pulled over creates anxiety regardless of the reason. However, if you work diligently at remaining calm, you will focus more clearly, and you will respond to the officer in a more professional and cooperative manner.
- You must refrain from making any unnecessary statements. Provide your driver’s license and insurance verification as quickly as possible. Verify your name, date of birth and current address if asked to do so. If the law enforcement begins to question you in regard to specific DUI information, you do not want to answer his or her questions. Respectfully tell the officer you have been advised not to answer those types of questions. Do not lie to the police; just politely explain you will not answer.
- Many citizens do not realize they may decline to perform a Field Sobriety Test (FST). Even someone who has not had one drink can fail this type of testing of balance and coordination testing.
- You are also entitled to decline the Preliminary Alcohol Screening (PAS). This test is administered at the place you were stopped and is supposed to give the police accurate blood-alcohol content (BAC) level. This type of test is not reliable and can result in false readings.
- If the officer does arrest you, you should be given the choice to submit to a breath test or a blood test. Opt to take the breath test only after your arrest. Decline the blood test. The breath test is not as reliable as the blood test and offers a better defense should you need to go to court.
